The contract is made directly with Corinthians, without any involvement from the sponsor Esportes da Sorte – the club says it will use its money to pay the salaries. The club, however, is responsible for the payment.
Under the terms of the agreement, any charges or disputes must be decided by the FIFA Player Status Chamber. This is because the player is a foreigner and would not need to go to a national court.
The court is more agile than the CNRD (CBF Chamber) and the national courts. Furthermore, it can establish a transfer ban for clubs in the event of conviction until the debt is paid.
There is also a contractual provision for accelerating the settlement of the remainder of the contract in the event of non-compliance with the amounts. Any failure to pay, therefore, leaves Corinthians in a difficult situation.
The Parque São Jorge club, with a debt of around R$2 billion, has a recent history of defaulting on player purchases or salaries.
