Husband knew nothing

It seemed like an exciting affair: a man and a woman who had met on TikTok, experienced intimate moments together and captured it on camera. But when the woman ended the relationship, things went wrong. The man was so angry about it that he sent the sexually explicit photos to her husband, who knew nothing about the affair. The woman filed a complaint. Yesterday, the two faced each other in the court of Alkmaar.
The 44-year-old suspect and the woman met via TikTok. She visited him, and they took pictures of her intimate parts and sexual acts between them. After she ended the affair, he sent the pictures to her husband.
Mental problems
The woman felt that her privacy had been violated, and claimed that she had suffered personal and psychological problems as a result of her ex-lover’s actions. She also said that she was afraid that he would send the photos to her family and work.
The public prosecutor argued that it was a case of ‘publishing sexually suggestive images while this causes harm to another person’. This has been punishable for a few years now, after young people in particular posted such images of ex-lovers online when the relationship was over. According to the ruling, this led to ‘the necessary consequences’ for the victims and in one case even to suicide.

The police judge ruled that there was indeed an act of revenge by the suspect, although he denied it. ‘Making public’, as stated in the law, can also include sending images to one person, says the judge. And the fact that she had cheated does not detract from the criminality of the suspect’s action.
Other possibilities
If the suspect’s only goal had been to inform the woman’s husband, then according to the police judge he could have done so in another way.
The woman was therefore proven right. Her ex-lover must pay 1000 euros in damages for the psychological suffering she suffered. The man was also given a 30-hour community service order and a 14-day suspended prison sentence.
That is a higher sentence than the public prosecutor had demanded, who only demanded a community service order of 60 hours, of which 30 hours conditional. According to the verdict, the man still stands by his action: he believes he has done nothing wrong.
