The Minister of Human Rights and Citizenship, Silvio Almeida, states that the end of temporary releases of prisoners is unconstitutional, “contradicts the idea of resocialization” and strengthens organized crime.
The head of the ministry says that “the way in which the issue is being dealt with in the country” goes against everything that has been done worldwide to rationalize and reduce pressure on the prison system”.
In March, Congress approved changes to the Penal Execution Law (LEP), ending temporary releases on commemorative dates for prisoners in the semi-open regime. Lula partially vetoed the text and, now, the project will be analyzed again by Congress.
The tendency is for the presidential veto to be overturned, which would reestablish restrictions on inmates being able to visit their families.
“This goes against the idea of resocialization, which is one of the objectives expressed in the logic of the Brazilian penitentiary system. In other words, this measure only serves to destabilize a system that already has many problems, in addition to strengthening organized crime that gains more manpower “, states Silvio Almeida in a note sent to the column.
And it continues: “We consider the project unconstitutional, as it makes resocialization unfeasible and tends to increase the chaos already prevailing in the penitentiary system.”
Before him, the Ministers of Justice, Ricardo Lewandowski, and the AGU (Attorney General of the Union), Jorge Messias, strongly defended with Lula the veto on the end of partying.
The two fought with the so-called hard line and pragmatic line of the government, who defended the maintenance of the article.
The hard wing, led by the Minister of the Civil House, Rui Costa, understands that criminal laws must be toughened in the country.
The pragmatic wing, which includes government leaders in Congress, is even against the end of the exit, but understands that the veto caused unnecessary wear and tear on Lula, as it would later be overturned by parliamentarians.
Last week, the CNBB (National Conference of Brazilian Bishops) spoke out in favor of maintaining the temporary release of prisoners on commemorative dates.
In the text, the Catholic entity states that “the state system must favor the reintegration of convicted people and promote reconciling justice” and that Brazilian legislation itself is based on the premise of reintegration. “Temporary departures during the sentence respond to these premises”, states an excerpt from the note.
The Federal Council of the OAB (Brazilian Bar Association) also unanimously approved an opinion that says that the bill that ends the temporary release of prisoners on commemorative dates is unconstitutional.
The opinion, by federal counselor Cristiano Barreto, states that the end of day outs “will imply a strong obstacle to the implementation of the resocialization of those incarcerated and will constitute a flagrant setback in terms of human rights, which reaches the fundamental core of the right to human dignity.”
