According to the court, on the basis of forensic examination and a reconstruction of the facts, it has been established that the serious internal injuries from which the baby died were not caused by a fall down the stairs, as the father stated. In the investigation of the Netherlands Forensic Institute, according to the court, it is sufficiently substantiated from a medical point of view that the fatal brain injury, from which the girl died, can only be caused by brute force from outside. That means by hitting, punching and/or shaking the baby hard.
