Suara.com – Chairman of the General Election Commission (KPU) of the Republic of Indonesia Hasyim Asy’ari ensured that his party would continue to carry out the stages of organizing the 2024 elections. This was conveyed because of a decision by the Central Jakarta District Court which ordered the KPU to stop the implementation of the stages of the 2024 elections and start from the beginning.
“We need to emphasize that the KPU will continue to carry out the stages of implementing or holding the 2024 Election,” said KPU RI chairman Hasyim Asy’ari in an online press conference, as monitored in Jakarta, Thursday (3/2/2023).
Hasyim explained that the reason for his party continuing to carry out the implementation of the 2024 election stages was because the Central Jakarta District Court’s decision regarding the Prima Party lawsuit did not target the KPU’s legal product in the form of KPU Regulation (PKPU) Number 3 of 2022 concerning Stages and Schedule for the 2024 Election.
Thus, he continued, the legal basis regarding the stages and schedule of the 2024 Election is still valid and has binding legal force to become the basis for the KPU to continue holding the stages of the 2024 Election.
Apart from that, Hasyim also stated that they could not implement the decision because the plaintiff was a political party participating in the 2024 election with the object of the lawsuit being a KPU decision regarding the determination of political parties participating in the 2024 election.
Furthermore, Hasyim considered that the claim from the Prima Party should be submitted to the state administrative court (PTUN) because this court has the authority to examine the products of state administration officials, such as the Indonesian KPU as state administrators, especially those holding elections.
“That authority lies with the Administrative Court and we state that it has been tested at the Administrative Court and has been declared unacceptable,” said Hasyim.

Previously, the Prima Party had taken legal action regarding the election process dispute regarding the determination of political parties participating in the 2024 Election by filing a lawsuit at the Jakarta Administrative Court.
“Then, the Jakarta Administrative Court terminated the legal action through Decision Number 468/D/SPPU/2022/PTUN.Jkt on December 26, 2022. Regarding this case, the PTUN passed a decision which in essence the plaintiff’s claim was not accepted,” said Hasyim.
Next, the Prima Party returned to taking legal action by filing a lawsuit at the Central Jakarta District Court regarding illegal acts allegedly committed by the Indonesian KPU in determining the political parties participating in the 2024 Election.
Prima Party’s lawsuit was granted
During a trial at the Central Jakarta District Court, Jakarta, Thursday, the panel of judges granted the Prima Party’s lawsuit against the KPU not to carry out the remaining stages of the 2024 election and carry out the election stages from the beginning for approximately 2 years 4 months 7 days.
“Punish the Defendant (KPU) not to carry out the remaining stages of the 2024 General Election since this decision was pronounced and carry out the General Election stages from the beginning for approximately 2 years 4 months 7 days,” said the panel of judges chaired by Oyong, quoted from decision Number 757/ Pdt.G/2022/PN Jkt.Pst.
In their considerations, the panel of judges ordered the KPU not to continue with the remaining stages of the 2024 Election in order to restore and create a just situation and protect it so that as early as possible other incidents do not occur due to errors, inaccuracies, inaccuracies, unprofessionalism and injustice that they committed as defendants.

In addition, the panel of judges also stated that legal facts had proven that there was an “error” condition in the Political Party Information System (Sipol) caused by the quality of the tools used or factors outside the infrastructure.
This happened when the Prima Party experienced difficulties in submitting data improvements for political party participants to Sipol which experienced “errors” in the system. Without tolerance for this matter, the KPU has determined the status of the Prima Party does not meet the requirements (TMS) as a political party participating in the 2024 election. (Antara)
