It is possible that during the holy month of Ramadan there are married couples who intentionally have intercourse during the day, but a question arises about who will pay expiation or fines, whether husband or wife.
According to Buya Yahya, when a husband and wife have intercourse during the day while fasting during Ramadan, the person who pays expiation is the husband. However, the sin of tarnishing the holy month of Ramadan is borne by the couple together.

Then he said that when a wife has refused her husband’s invitation to have intercourse during Ramadan, then she will be free from sin.
“Unless the wife refuses and then is threatened, then the wife does it because she is forced to, the wife is free from sin, but if both agree, then the husband alone (pays expiation),” he added.
Buya advised Muslims who are already married to be able to hold their lust for a few hours until it is time to break the fast, then if the couple has intercourse, they will be subject to kifarat in accordance with the provisions of the shari’a.
“Just be patient for a few hours, don’t force yourself in the holy month of Ramadhan to seek God’s wrath. The punishment is to set the slave free and fast for two consecutive months, if you can’t afford it then feed sixty poor people,” he said.
Then he added that this was not a problem regarding the amount of payment issued for expiation, but about a sin and punishment from Allah for having intercourse between husband and wife during the day during the fasting month of Ramadan.
