A comic called Zarya of the Dawn and whose images were created with the Artificial Intelligence Midjourney, has been rejected by the US Copyright Office, who indicate that they would not have copyrights because they were created by a “non-human ”. Although on the other hand, the work will have protections for the text and arrangements, which were created by the human Kris Kashtanova.
And in a confusing series of tweets, Kashtanova said that this was a victory for the AI community, ensuring that Zarya of the Dawn had its copyright “affirmed”, something that reading the letter where the Office delivered its decision, it follows that it is totally wrong.

This since the document ensures that the author did not say that he used the Midjourney software originally when he applied for copyright registration last year, so the new partial copyright replaces the previous one, which completely covered the comic, which was supposed to be Created entirely by a human. In other words, and contrary to what its author says, the decision is actually a blow to the defenders of the creation of works through Artificial Intelligence in the United States since it becomes a precedent.
As Kashtanova told Kotaku, she never planned to “monetize” the comic, assuring that together with her lawyers “we are discussing an appeal.” Something that will be taken with caution and at a slow pace, since according to her words: “I would like to think about it for a few days because it has been an emotional journey. I was often harassed online for using AI tools and being in the news so much.”
