Parking the motorcycle or scooter on the sidewalk is now a widespread habit, and it is often believed that these vehicles are exempt from penalties such as no parking. Unfortunately this is not the case, and to tell us more or less clearly is the Highway Code; article 158 paragraph 1h in fact states that: “The stop and the stop they are prohibited on the sidewalks, unless otherwise indicated”.
The type of vehicle is not specified, so the rule is general and applies to everyone, either car and motorbike. In addition, parking is prohibited also the stop, which is temporary and short-lived. It would therefore seem that one cannot really stand on the sidewalk. However, the aforementioned paragraph concludes with a clarification which, as often happens, confuses ideas and leaves room for interpretation.
So what is meant by “different reporting”?
Stop and stop your two or four wheeled vehicle are allowed only when there is one special signage which indicates this possibility. In the specific case of two wheels there must be stalls bordered with painted white stripes on the pavement and marked with vertical signs depicting the symbol of the motorcycle and the motorcyclist. So be careful not to confuse them with the spaces reserved for sharing e-bikes.
Making a stop or a stop on the sidewalk is therefore not permitted, because it is an ad venue exclusive use of pedestrians, and is not part of the roadway. For this reason, sanctions described in article 158 of the CDS, paragraph 5 are incurred: “Anyone who violates the provisions (…) of paragraph 2 is subject to the administrative sanction of the payment of a sum from €41 to €168 for mopeds and two-wheeled motorcycles”. This is therefore a significant financial penalty.
Reasoning with common sense, which unfortunately the municipal administrations very often lack, placing one’s two-wheeled vehicle on a sidewalk without hindering the public road system or the entrance to homes and commercial activities does not “hurt” anyone. To give a hand to this la lack of dedicated stallspresent only in very few areas of the city and in a number much lower than that of the demand, moreover often squatted from vans or cars.
