The Court ruled on a dispute against the Campidoglio for a 100 euro fine: “The road signs make it clear”

Around ten thousand microcars compete for parking space with scooters and bicycles every day. But can a mini car really park on the strips reserved for two wheels? Let’s clarify.
According to belief yes, but it is not so, however, for the judges of Cassation which, in recent days, they agreed with the Capitol about a dispute with the Ferrari Representations Federico and Andrea srl. The subject of the dispute concerned a fine (from 100 euros) taken from a microcar parked on the strips reserved for scooters in via Fabio Massimo in Prati, Rome. The story It dates back to 2014 and the Ferrari Representations appealed to the justice of the peace who proved them wrong, however. The appeal to the Supreme Court was therefore triggered as anticipated by the newspaper Il Tempo.
In recent days, the judges of the Cassation ruled again rejecting the appeal of the Ferrari Representations and instead agreeing with the Capitoline lawyers, who underlined that in that parking area there was «a road sign which clearly stated that the parking was reserved for two-wheeled vehicles.
The company that owns the microcar complains of an injustice by the traffic police who fined the users of the car. The disputed subject is the equivalent to motorcycles of a microcar which “could have legitimately parked in the spaces set up for them”. But the matter is disputed by the judges who reject the argument stating that the white stripes drawn on the asphalt legitimize the only parking of the scooters.
In this respect, the legislation appears clear according to the cassation: “Drivers are required to fix their vehicle in the space intended for it without invading adjacent spaces. This implies that in the case of microcars parked in the spaces used for parking mopeds (obviously narrower) it must be considered that their stop was made illegally”. The debate is open.
