Public Prosecutor Sugeng Hariadi’s decision to demand that Richard Eliezer Pudihang Lumiu be jailed for 12 years in the premeditated murder case of Brigadier Nofriansyah Yosua Hutabarat sparked a number of negative reactions from various parties. The Witness and Victim Protection Agency (LPSK) asked the prosecutor to revise their charges.
Quoted from the Antara news agency, the LPSK wants the charges against Bharada E or Richard Eliezer Pudihang Lumiu to be lower than the other defendants. Namely Putri Candrawathi, Strong Maruf, and Ricky Rizal, who were charged with eight years in prison.
The team of prosecutors was of the opinion that the charges they submitted to the panel of judges against Defendant Bharada E met the principles of legal certainty and a sense of justice.
“The public prosecutor’s team considered the role of the defendant Richard Eliezer as the executor or perpetrator who shot the victim Yosua three, four times; so based on this, we, the public prosecution team, demand that the defendant Richard Eliezer be served 12 years in prison,” explained Sugeng Hariadi.
He acknowledged that the situation faced by the accused, Richard Eliezer or Bharada E, gave rise to a juridical dilemma.
“That this condition raises a juridical dilemma because on the one hand, the defendant Richard Eliezer is categorized as a witness or cooperating actor,” said Attorney Sugeng Hariadi at the South Jakarta District Court (PN), Jakarta, Monday (30/1/2023).
The prosecutor considered Richard Eliezer’s courage and honesty to have contributed to exposing the crime planned to kill Joshua. Apart from that, Eliezer’s bravery contributed to dismantling the deception scenario created by the main perpetrator of the murder, Ferdy Sambo.
“However, on the other hand, the role of the defendant Richard Eliezer as the executor of the shooting of the victim Nofriansyah Yosua Hutabarat also needs to be considered clearly and objectively,” said Sugeng Hariadi.
Thus, the team of prosecutors also rejected the defense plea submitted by legal adviser Richard Eliezer.
