Suara.com – Member of Commission III DPR RI from the Gerindra Party faction Habiburokhman urged the police to revoke the status of the suspect of the late Muhammad Hasya Athallah, a University of Indonesia student who was killed by the former Cilincing Police Chief, AKBP (Purn) Eko Setia Budi Wahono. Apart from that, Habiburokhman asked the police to restore the good name of the late Hasya.
“Against the late Hasya, I ask that the determination of the suspect against the deceased be revoked, and his good name restored. Because it doesn’t make sense, it’s impossible to name a dead person as a suspect,” said Habiburokhman at the Senayan Parliament Complex, Jakarta, Tuesday (31/1/2023) .
Habiburokhman refers to Article 77 of the Criminal Code. Where, he said, the determination of the suspect could fall if the suspect later died.

“This person died from the start, was named a suspect. I asked Propam to go down and examine these investigators. How can you name a deceased person as a suspect?” he said.

“This doesn’t make sense and this really hurts the sense of justice,” continued Habiburakhman.
Previously, Commission III of the Indonesian House of Representatives considered that the police’s move to name a University of Indonesia student, the late Muhammad Hasya Athallah (MHA) as a suspect in the accident that killed him was inappropriate.
Member of Commission III DPR RI from the PPP faction Arsul Sani said that it was not correct from the procedural law side to the other side.
“We see that the designation of the deceased as a suspect is not appropriate, from the legal point of view of the procedure or from the point of view of our psychological needs or empathy for the victim,” said Arsul at the Senayan Parliament Complex, Jakarta, Monday (30/1/2023).
Arsul said that based on procedural law, first in the Criminal Procedure Code, the determination of the suspect must be based on two preliminary pieces of evidence. The evidence, said Arsul, includes witness testimony, letters, expert testimony, defendant’s statement and instructions.

“The question has been fulfilled or not?” Arsul said.
