The judges did not recognize any extenuating circumstances for the elder of the two brothers, except for generic ones. For the judges, in fact, the mitigating circumstance of the provocation could have been configured if the injuries had been only those procured “hot”, that is, in the initial phase of the brawl. Furthermore, for the Assize Court, presided over by Judge Massimo Cusatti, it is not possible to invoke self-defense as in the case of the parricide of Turin which led to the acquittal in first instance of Alex Pompa, who allegedly killed his father to defend his mother. who was in the place where the murder had taken place, given that Alessio and Simone’s mother was in a distant and safe place.
And the mother of the two boys is assigned a “moral” responsibility in the sentence: that of having put pressure on the children by assigning them “a role of intermediaries” for which “they had no title, instrument or ability” and “by giving them an abnormal responsibility“the judges write, while specifying, however, that there is” no etiological link between the pressure of the woman and the murder. “Now the defense lawyers of the boys, Luca Rinaldi and Nadia Calafato, have 45 days to lodge an appeal.
