Loano – You do not need permission to build for a curtain mounted to cover the terrace: this is how a sentence of the Council of State has confirmed the cancellation of the demolition order that in 2020 the Municipality of Loano (Savona) had imposed on a couple owner of an apartment in an area of historical interest in the western Ligurian town.
“The main work is not the frame itself, but the curtain, as an element of protection from the sun and atmospheric agents, aimed at a better use of the external space of the house, with the consequence that the frame is an accessory element – explains the Council of State in the sentence that rejects the appeal of the Municipality of Loano already defeated at the TAR of Liguria – The deployment of the tent and the natural sheets is not in itself suitable to give the structure the nature of new construction, as such requiring a specific building permit (and least of all the building permit). The interventions of furnishing open spaces with light materials must normally be considered freely admissible: These are works that can be carried out in a free building regime “.
